House of Darling, LLC
This Client Agreement, Disclosure, and Waiver (this “Agreement”) is entered into between you and House of Darling, LLC, a Tennessee limited liability company (“House of Darling,” “we,” “us,” or “our”). It applies to every reading, intuitive consultation, and related service you receive from us, whether delivered by pre-recorded video, live video session, or in person (the “Services”).
This Agreement supplements, and does not replace, our Terms of Use and User Agreement, our Privacy Policy, and our Booking, Cancellation and Refund Policy, each of which is incorporated into this Agreement by reference (each available at houseofdarlingtarot.com and provided to you on request). If any conflict exists between this Agreement and those documents as to the subject matter of this Agreement, this Agreement controls for in-person and live individual sessions, except that the Booking, Cancellation and Refund Policy controls as to cancellation and refunds, and the Terms of Use control for all other matters. Please read this Agreement carefully. If there is anything you do not understand, ask before you sign.
Nature of the Services
House of Darling provides tarot reading and intuitive consultation for personal insight, reflection, and general guidance. Tarot reading and intuitive consultation are not recognized by any scientific or professional body as a means of diagnosis, prediction, or decision-making, and are not a substitute for professional advice of any kind.
We make no representation or warranty that any reading or consultation is accurate, reliable, complete, predictive, or suited to any particular purpose. No specific result, outcome, or benefit is promised or guaranteed. You should not treat anything said or written in connection with the Services as a statement of fact, and you are solely responsible for every decision you make and every action you take or do not take, whether or not you consulted the Services beforehand.
Not a Licensed Professional; No Professional Advice
Not a Licensed Professional
Sophie Darling and House of Darling are not physicians, nurses, psychologists, psychiatrists, therapists, counselors, social workers, dietitians, licensed healthcare providers of any kind, attorneys, accountants, financial planners, or investment advisers, and hold no license in any of those fields. The Services are not licensed by the State of Tennessee or by any other state.
No Medical Advice
We do not diagnose, treat, cure, prevent, or advise upon any physical or mental health condition. We do not provide medical opinions, interpret symptoms or test results, recommend or discourage any treatment, medication, therapy, supplement, diet, or course of care, and we do not advise you to start, stop, delay, or change anything a licensed healthcare provider has recommended. Any observation, impression, or reference to the body, energy, wellness, or health made during a reading is offered for personal insight and reflection only and is not a medical statement of any kind. It is your responsibility to consult your own licensed healthcare provider for any physical or mental health concern, and you should never delay seeking, or disregard, professional medical or mental health advice because of anything said or provided in connection with the Services.
No Mental Health or Counseling Services
The Services are not psychotherapy, counseling, psychological treatment, or any other form of mental health care, and are not a substitute for care from a licensed mental health professional. A reading is not a therapeutic relationship and creates no duty of care of the kind owed by a treating clinician.
No Financial or Legal Advice
We do not provide financial, investment, tax, insurance, business, accounting, or legal advice, and no attorney-client relationship arises from the Services. We make no warranty, guarantee, or prediction of future performance regarding any investment, security, cryptocurrency, real property, business venture, or other financial matter. You agree to consult a qualified, licensed professional before making any financial, legal, or other consequential decision, and not to rely on the Services in making it.
Consequential Decisions
You agree not to rely on the Services in making decisions concerning pregnancy, fertility, medical treatment, ending or beginning a relationship or marriage, custody of a child, employment, immigration status, criminal matters, or the safety of yourself or another person, and to consult a qualified professional in each such case.
Not an Emergency Service
The Services are not a crisis, emergency, or support line, and are not monitored. If you are experiencing a medical or mental health emergency, or are concerned about your safety or the safety of another person, contact your local emergency number, or in the United States call or text 988 to reach the Suicide and Crisis Lifeline.
Assumption of Risk. You understand and voluntarily accept that:
the subject matter of a reading may be emotionally significant, unexpected, uncomfortable, or upsetting, and you accept that risk;
you may, during or after a session, experience emotional or physical responses, and you assume full responsibility for your interpretation of, reaction to, and reliance on anything arising from the Services;
you are participating of your own free will, are not under any compulsion to accept or act on anything said, and may withdraw your participation at any time; and
you are responsible for your own wellbeing and for seeking qualified professional help if you need it.
Release and Waiver of Liability
YOU KNOWINGLY, VOLUNTARILY, AND INTELLIGENTLY RELEASE, WAIVE, AND DISCHARGE HOUSE OF DARLING, LLC, AND ITS MEMBERS, MANAGERS, AGENTS, AND CONTRACTORS, FROM ANY CLAIM, DEMAND, DAMAGE, OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO THE SERVICES, INCLUDING CLAIMS FOR EMOTIONAL DISTRESS, RELIANCE, DISAPPOINTMENT, OR THE CONSEQUENCES OF ANY DECISION YOU MADE, TO THE FULLEST EXTENT PERMITTED BY TENNESSEE LAW.
This release does not apply to, and nothing in this Agreement waives or limits, liability for gross negligence, willful or wanton misconduct, fraud, intentional misconduct, or any liability that may not lawfully be released or limited, including any right or remedy under the Tennessee Consumer Protection Act, Tenn. Code Ann. § 47-18-101 et seq., which may not be waived in advance. Nothing in this Agreement limits any right you have under a law that cannot be waived by agreement.

Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HOUSE OF DARLING, LLC AND ITS MEMBERS, MANAGERS, AGENTS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST OPPORTUNITY, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATING TO THE SERVICES, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID HOUSE OF DARLING FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100).
These limitations do not apply to liability for gross negligence, willful or wanton misconduct, fraud, or any liability that may not lawfully be limited, including claims under the Tennessee Consumer Protection Act.
Confidentiality and Recording
We treat what you tell us as confidential and do not disclose it except as described in our Privacy Policy. This confidentiality is a matter of practice and contract only. It is not a legally recognized privilege, and it does not protect the content of a reading from disclosure if we are compelled by subpoena, court order, or law.
You may record your own live or in-person session for your personal use, provided you tell us before recording begins. Any recording you make, and any pre-recorded reading we deliver to you, is licensed to you for your personal, non-commercial use only. You may not publish, post, broadcast, stream, sell, license, distribute, or make it publicly available, and you may not use it in advertising or in any commercial context, without our prior written consent. Because a reading may involve information about you or others, you are responsible for how you store and share any recording you make. A reading, and any recording of it, is not evidence and may not be offered as proof of any fact in any proceeding.
Readings Concerning Third Parties
You may not ask for a reading about, or concerning, another identifiable person without a legitimate personal connection to that person and to the question, and we may decline any such request. We do not provide readings intended to locate, surveil, investigate, or make findings about another person. Anything said about another person in a reading is offered for personal insight and reflection, is not a factual assertion about that person, and must not be repeated, published, or acted upon as though it were.
Fees, Cancellation, and Conduct
Fees are due as stated at the time of booking and are governed by our Booking, Cancellation and Refund Policy. You are personally responsible for the fees for your session.
We may decline to provide, or may discontinue, a reading for any person who is disruptive, abusive, intoxicated, or where we believe the Services are not appropriate, and we may end a session or our attendance at an event if the environment becomes unsafe, abusive, or unmanageable.
Eligibility and Consent
The Services are available to individuals sixteen (16) years of age and older. If you are signing on your own behalf, you represent that you are at least sixteen (16) years of age and have the legal capacity to enter into this Agreement. If the person receiving the Services is sixteen (16) or seventeen (17) years of age, this Agreement must be signed by that person’s parent or legal guardian, who represents that they have full legal authority to consent on the minor’s behalf, agrees to be bound by this Agreement, and is responsible for the minor’s compliance with it and for all fees incurred.
Your consent to the Services is given voluntarily and without coercion, and may be withdrawn at any time. You represent that you are able to understand the nature and consequences of the Services.
Acknowledgment
By signing below, you acknowledge that House of Darling has disclosed sufficient information for you to make an informed decision to engage the Services, that you have read and understand this Agreement, that you have had the opportunity to ask questions, and that you agree to each of its terms, including the assumption of risk in Section 3, the release and waiver in Section 4, and the limitation of liability in Section 5. You further acknowledge that you are entering into this Agreement freely and voluntarily.
This Agreement is governed by the laws of the State of Tennessee, without regard to conflict-of-laws principles, and is binding upon you and your heirs, successors, and legal representatives. You agree that any claim arising out of or relating to the Services or this Agreement will be brought exclusively in the state or federal courts located in Davidson County, Tennessee, that you will not commence or maintain any such claim in any court or tribunal outside the United States, and that this Agreement is subject to the dispute-resolution and arbitration provisions of our Terms of Use, including the class-action waiver, which are incorporated by reference. If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect.
